The Italian Supreme Court on Italian Law No 218 of 1995 on recognition of foreign judgments in Italy

The Italian Supreme Court, by order No 1255/25, published on 18 January 2025, in the matter of recognition of foreign judgments in Italy, under Italian Law No 218 of 1995, confirmed that the defects that – if promptly deducted before the foreign court – would have affected the judgment cannot be relied, for the first time, before the Italian court. This applies also with regard to the alleged lack of jurisdiction, according to the principles proper to the Italian legal system, pursuant to Article 64, first paragraph, lett. a), since it is a matter that may be subject to derogation, pursuant to Article 4.
