The Italian Supreme Court on Article 35 (2) of the Vienna Convention 1980

22 January 2023

The Italian Supreme Court, by order No 36144/22, published on 12 December 2022, in the matter of contracts for the international sale of goods, ruled that the provision of Article 35 (2) of the Vienna Convention on 11 April 1980 (CISG) – which states standards for determining whether goods delivered by the seller are conform to the contract (in terms of type, quantity, quality, and packaging) – shall apply automatically, except where the parties have agreed otherwise.
