The Italian Supreme Court on the recognition and enforcement in Italy of foreign arbitral awards under the New York Convention 1958

The Italian Supreme Court, by order No 21130/25, published on 24 July 2025, on the recognition and enforcement in Italy of foreign arbitral awards, confirmed that, pursuant to article 5, 2 paragraph, letter b), of the New York Convention of 10 June 1958, no review of the merits of the award is allowed and provisions contrary to public policy must be assessed with exclusive regard to the dispositive part of the arbitration decision, although understood in its concrete scope, through the comparison with the expositive part and the motivating one.
