The Italian Supreme Court on Italian Law No 218 of 1995 on recognition of foreign judgments in Italy

The Italian Supreme Court, by order No 3199/23, published on 2 February 2023, in the matter of recognition of foreign judgments in Italy, pursuant to Italian Law No 218 of 1995, confirmed that the defects that – if promptly deducted before the foreign court – would have affected the judgment cannot be relied, for the first time, before the Italian court. This applies also with regard to the alleged lack of “jurisdiction”, according to the principles proper to the Italian legal system, pursuant to Article 64, first paragraph, lett. a), since it is a matter that may be subject to derogation, pursuant to Article 4.
